CFC Supports AB 634 (Steinberg) – Elder Abuse Actions – Signed
Established state policy disfavoring secret settlements of lawsuits brought under the Elder Abuse and Dependent Adult Civil Protection Act (EADACPA) that conceal evidence of financial abuse, neglect, or physical abuse. The law requires a showing before a confidentiality agreement in an EADACPA proceeding may be recognized or enforced by the court.
The law provides that in any civil action for a violation of the EADACPA, information other than evidence of abuse of an elder or dependent adult may be protected from disclosure by a protective order.
By creating a public right to know of evidence of elder abuse, AB 634 gives nursing home operators an incentive to provide quality care in their facilities.
